Sale Agreement of House Including Vehicle and Deferred Payment

This Sale Agreement is executed on this day, 03-05-2021, by and between the following parties under the terms and conditions set forth herein:

Party Details:

  1. Seller (First Party):
    Nabeel Ahmed, son of Muhammad Nabeel,
    Resident of Dak Khana Khas Rawat, Tehsil and District Islamabad.

  2. Buyer (Second Party):
    Zafran Abbasi, son of Muhammad Abbasi,
    Resident of Dak Khana Harka, Bhamli, Tehsil and District Rawalpindi.
    CNIC No.: 37405-12121214-1

Subject Property:

  1. The First Party is the lawful owner and in possession of a residential house constructed on a 10 Marla plot, comprising two rooms, a veranda, kitchen, staircase, and boundary wall, situated at Khasra No. 4545, Mauza Rawat, Tehsil and District Rawalpindi.
  2. The boundaries of the house are as follows:
  • East: House of Raja Jahangir
  • West: House of Nadeem Abbas
  • North: House of heirs of Gulzar Khan
  • South: Street

Sale Consideration:

  1. The total sale consideration for the property is agreed at PKR 4,000,000/- (Four Million Rupees), out of which the Buyer has paid:
  • PKR 500,000/- in cash on this date, i.e., 03-05-2021, and
  • Transferred one vehicle: Toyota Corolla GLI, Model 2012,
    Registration No.: AB-1223, Engine No.: Y552418,
    Chassis No.: NZE140-2138232,
    Valued at PKR 1,900,000/-, along with original registration documents and biometric transfer.
  1. Therefore, a remaining balance of PKR 1,600,000/- (One Million Six Hundred Thousand Rupees) is due on the Buyer, which he undertakes to pay to the Seller within two (2) months at the time of registration/transfer of ownership.

Terms & Conditions:

  1. If the Buyer fails to pay the remaining amount within the stipulated period:
  • The amount already paid and the vehicle transferred shall be forfeited in favor of the Seller.
  1. If the Seller fails to transfer the property in favor of the Buyer within the stipulated period or causes unnecessary delay:
  • The Seller shall be liable to pay double the amount received (i.e., PKR 4,800,000/-) in cash and vehicle value to the Buyer.

Legal Declarations:

  1. The Seller affirms and warrants that:
  • The subject property is free from all legal encumbrances, loans, gifts, prior sale agreements, wills, guarantees, and disputes.
  • No stay order or injunction has been issued by any court of law regarding the subject property.

Conclusion:

This agreement is made voluntarily, without any coercion, and in full senses, witnessed by the undersigned witnesses to serve as a legal reference and evidence whenever required.

یہ اقرار نامہ بیع آج مورخہ 03-05-2021 کو بقائمی ہوش و حواس و برضا و رغبت، فریقین کے مابین درج ذیل شرائط و ضوابط کے تحت تحریر کیا گیا:

فریقین کا تعارف:

  1. فریق اول / بائع:
    نبیل احمد ولد محمد نبیل، ساکن ڈاکخانہ خاص روات، تحصیل و ضلع اسلام آباد،
    شناختی کارڈ نمبر: 37405-12121214-1
  2. فریق دوم / مشتری:
    زعفران عباسی ولد محمد عباسی، ساکن ڈاکخانہ ہرکہ، بھملی، تحصیل و ضلع راولپنڈی،
    شناختی کارڈ نمبر: 37405-12121214-1

اقرار و فروخت مکان:

  1. فریق اول ایک عدد مکمل تعمیر شدہ مکان مالک و قابض ہے، جو بر رقبہ 10 مرلے واقع موضع روات، خسرہ نمبر 4545، تحصیل و ضلع راولپنڈی میں واقع ہے، جس میں دو کمرے، برآمدہ، کچن، سیڑھیاں اور چار دیواری شامل ہیں۔
  2. مکان کی حدود اربعہ درج ذیل ہیں:
  • مشرق: مکان راجہ جہانگیر
  • مغرب: مکان ندیم عباس
  • شمال: مکان وارثان گلزار خان
  • جنوب: گلی

قیمت و ادائیگی:

  1. مذکورہ مکان کی کل قیمت مبلغ روپے 40,00,000/- (چالیس لاکھ روپے) طے پائی، جس میں سے فریق دوم نے:
  • آج مورخہ 03-05-2021 کو روپے 5,00,000/- نقد ادا کیے، اور
  • ایک عدد گاڑی ٹویوٹا کرولا GLI، ماڈل 2012، رجسٹریشن نمبر AB-1223، انجن نمبر Y552418، چیسس نمبر NZE140-2138232، مالیتی روپے 19,00,000/- بمعہ اصل رجسٹریشن کاغذات و بایومیٹرک حوالہ فریق اول کیا۔اس طرح اب بقایا رقم روپے 16,00,000/- فریق دوم پر باقی ہے، جو وہ مدت دو ماہ میں رجسٹری یا انتقال کے وقت فریق اول کو ادا کرنے کا پابند ہوگا۔

شرائط و ذمہ داریاں:

  1. اگر فریق دوم مقررہ مدت میں بقایا رقم کی ادائیگی نہ کرے، تو:
  • ادا شدہ رقم اور مذکورہ گاڑی بحق فریق اول ضبط ہو جائے گی۔
  1. اگر فریق اول مقررہ مدت میں مکان فریق دوم کے نام منتقل نہ کرے یا ٹال مٹول کرے تو:
  • فریق اول پر لازم ہوگا کہ وہ فریق دوم کو رقم و گاڑی کا دوگنا یعنی روپے 48,00,000/- ادا کرے۔

حلف و قانونی وضاحت:

  1. فریق اول اس بات کی یقین دہانی کرواتا ہے کہ:
  • مکان مذکورہ ہر قسم کے قانونی سقم، قرض، ہبہ، بیع، وصیت، گارنٹی، عدالتی تنازعہ یا حکم امتناعی (Stay Order) سے پاک و صاف ہے۔

اختتامی شق:

یہ اقرار نامہ فریقین نے باہمی رضا مندی، مکمل ہوش و حواس اور بلا جبر و اکراہ، گواہان کی موجودگی میں تحریر کرایا تاکہ سند رہے اور بوقت ضرورت کام آوے۔
