Agreement to Sell Vehicle - Bank Lease

This agreement is made on 24 November 2016 between:

First Party / Seller:
Mr. [Name Hidden], son of [Father’s Name Hidden], resident of [Address Hidden], Rawalpindi. CNIC No. [Hidden]

Second Party / Buyer:
Mr. [Name Hidden], son of [Father’s Name Hidden], resident of [Address Hidden], Rawalpindi. CNIC No. [Hidden]

The First Party is the lawful lessee of a Suzuki Bolan, details as follows:

  • Registration Number: CE-4545 (Islamabad)
  • Chassis Number: NE454577
  • Color: Black
  • Model Year: 2012
  • Engine Capacity: 1300 CC

The vehicle is currently under a 5-year lease agreement with HBL Bank. Out of 50 total installments, 21 installments have been paid, and 29 installments are pending.

The First Party has agreed to sell the said vehicle to the Second Party for a total price of Rs. 660,000/- (Six Lakh Sixty Thousand only). The Second Party has paid this amount in full to the First Party on 24 November 2016, and the First Party has handed over the vehicle along with the original registration book to the Second Party.

Key Terms Agreed Upon:

  1. The Second Party is solely responsible for paying the remaining 29 installments directly to the bank.
  2. Upon completion of all installments, the First Party shall obtain a No Objection Certificate (NOC) from the concerned bank and shall transfer the vehicle to the Second Party’s name.
  3. In case of any delay or default in installment payments, the Second Party shall bear all penalties or losses.
  4. If the vehicle is found to be stolen, tampered (engine/chassis tampering, cut-and-weld), involved in any legal dispute, or has document inconsistencies prior to the date of this agreement, the First Party shall be held liable and must refund the full amount to the Second Party.
  5. Any dues or liabilities related to the vehicle before today shall be the responsibility of the First Party, and the Second Party shall have no connection with them. From today onwards, all responsibility shifts to the Second Party.

This agreement is made voluntarily by both parties in full senses, without coercion or pressure, and in the presence of witnesses, for future legal use.

یہ اقرار نامہ مورخہ 24 نومبر 2016 کو درج ذیل فریقین کے مابین طے پایا:

فریق اول / فروخت کنندہ:

فریق دوم / خریدار:

فریق اول ایک عدد گاڑی سوزوکی بولان، رجسٹریشن نمبر CE-4545 (اسلام آباد)، چیسز نمبر NE454577، برنگ کالا، ماڈل 2012، ہارس پاور 1300-CC، کا قانونی لیز ہولڈر ہے۔ مذکورہ گاڑی HBL بینک سے پانچ سالہ لیز پر حاصل کی گئی ہے۔ اب تک 21 اقساط ادا ہو چکی ہیں جبکہ 29 اقساط باقی ہیں۔

فریق اول نے مذکورہ گاڑی فریق دوم کو مبلغ 660,000/- روپے (چھ لاکھ ساٹھ ہزار روپے) میں فروخت کر دی ہے۔ یہ مکمل رقم فریق دوم نے مورخہ 24 نومبر 2016 کو نقد ادا کر دی، اور فریق اول نے گاڑی بمعہ اصل رجسٹریشن بک حوالے کر دی۔

اقرار کی شرائط:

  1. گاڑی کی بقیہ 29 اقساط بینک میں جمع کروانے کی مکمل ذمہ داری فریق دوم کی ہوگی۔
  2. تمام اقساط کی ادائیگی کے بعد، فریق اول متعلقہ بینک سے این او سی حاصل کرکے گاڑی فریق دوم کے نام منتقل کروانے کا پابند ہوگا۔
  3. اقساط کی عدم ادائیگی یا تاخیر کی صورت میں تمام مالی نقصان فریق دوم پر عائد ہوگا۔
  4. اگر گاڑی چوری شدہ، انجن یا چیسز نمبر میں ٹمپرنگ شدہ، کٹ اینڈ ویلڈ شدہ، یا کسی قانونی تنازع کا شکار نکلی، تو فریق اول مکمل طور پر ذمہ دار ہوگا اور مکمل رقم واپس کرنے کا پابند ہوگا۔
  5. آج سے پہلے کی کسی بھی لین دین یا واجبات کی مکمل ذمہ داری فریق اول کی ہوگی، اور فریق دوم کا ان سے کوئی تعلق نہیں ہوگا۔ آج کے بعد کی تمام ذمہ داری فریق دوم پر ہوگی۔

یہ معاہدہ دونوں فریقین نے مکمل ہوش و حواس میں، بلا جبر و کراہ، گواہوں کی موجودگی میں تحریر کیا اور اس پر دستخط اور نشان انگوٹھا ثبت کیے تاکہ بطور سند استعمال ہو سکے۔
