After 3 talaq in one go (in pregnancy). Is there any chance of reconciliation?

Pronouncement of Three Divorces There are differing views on the validity of pronouncing three divorces in one sitting. Some interpret this as a single revocable divorce, while others view it as an irrevocable divorce (Talaq-e-Biddat). The court in Mst. ANILA versus MUHAMMAD MUNIR and others, PLD 1996 Lahore 65 stated that three pronouncements of divorce in one sitting (Tuhr) are irrevocable, even in the case of an unconsummated marriage, based on Islamic injunctions

Reconciliation Even if three pronouncements have been made, reconciliation is possible under certain interpretations:

  • Revocation Period: The husband can revoke the Talaq before the expiration of 90 days from the notice given to the Chairman, as highlighted in Shaista Arshi v. Chairman, Union Committee, Ward No. 48, Lahore, PLD 1988 Lahore 498.
  • Remarriage: If the divorce becomes final, the couple may remarry, unless it is the third divorce.

Pregnancy If the Talaq is pronounced during pregnancy, the Iddat period (waiting period) extends until the end of the pregnancy. The court in Muslim Family Laws Ordinance (VIII of 1961) made observations on the commencement of the Iddat period and referenced PLD 1988 Kar. 169, emphasizing that Shariah’s waiting period (Iddat) is a mandate and commences from the time the divorce is pronounced.

In conclusion, although the pronouncement of three Talaqs in one go is generally considered an irrevocable divorce, there’s still a possibility of reconciliation, particularly if the Talaq is not yet effective, or if the couple choose to remarry after the divorce becomes final, provided that it is not the third and final divorce.
